Rules of Complaints Procedure

  1. The present Rules of Complaints Procedure have been drafted pursuant to Act No. 89/2012, the new Civil Code, and Act No. 634/1992, the Consumer Protection Act, as amended, and it applies to consumer goods in respect of which the buyers' rights from liability for defects are claimed during a warranty period.
  2. The warranty period regarding consumer goods has been stipulated at 24 months and it shall be further extended by such period of time which the article spends under warranty repair.
  3. The consumer is entitled to make legitimate claims in one of the following ways:

  1. The consumer is obliged to support his or her claims with:

- a proof of sale of the goods (tax invoice, invoice, warranty card);

- the goods claimed complete with all accessories;

- detailed descriptions of the defect claimed.

  1. The consumer shall be issued a proof of receipt of the claimed article at the premises of the company.
  2. Warranty shall not apply in cases of:

- wear and tear of the article resulting from regular use;

- improper handling and use contrary to instructions of use or user’s manual;

- damage caused by natural elements (e.g., water, fire or lightning, etc.);

- damage caused by excessive load;

- damage caused to the goods during transport (such complaint should be handled directly by the carrier).

  1. In case of a justified complaint, the goods will be repaired free of charge. If the defect cannot be repaired, the goods shall be replaced with new goods. In the event of replaced goods, a new warranty period commences to run.
  2. The deadline for settling claims, including removals of defects, shall extend, without any undue delay, to 30 calendar days, unless the parties agree otherwise. Such term shall commence on the date of receipt of the claim. If the deadline is not complied with, the consumer shall be entitled to seek a replacement of such defective goods or to withdraw from the contract.

The present Rules of Complaints Procedure take effect as of 15 July 2014. The company reserves the right to amend the Rules of Complaints Procedure from time to time.
